Learning Management System (LMS) Usage Policy

1. Introduction

This document outlines the terms and conditions for accessing and using the Learning
Management System (LMS) of CustomerXPs Software pvt ltd. This policy is designed to
protect the intellectual property contained within the LMS and to ensure that all content
remains confidential and secure.

2. Acceptable Use

  • Access: Access to the LMS is restricted to authorized users and each authorized user will be issued a User ID and password for purposes of authentication and authorization from CustomerXPs Software pvt ltd. Users are responsible for keeping their login information confidential.
  • Usage: The LMS is intended for professional development and training purposes only. Users may not use the LMS for any other purposes, including commercial use or for personal gain.
  • Course Timeline: Each course has a defined start and end date, which will be communicated at the time of enrolment. Access to the LMS will be available from the oGicial start date until the end date of the course.

3. Intellectual Property Rights

  • All content displayed and available within the LMS, including but not limited to text, graphics, logos, images, coursework materials, and training modules, is the property of CustomerXPs Software pvt ltd and/or its content suppliers and is protected by copyright and other intellectual property laws.
  • Users are granted a limited, non-exclusive, non-sublicensable, non-transferable license to access and

4. Prohibitions on Content Use

  • Copying/Distribution: Users may not copy, reproduce, republish, upload, post, transmit, sublicense or distribute any material from the LMS in any form without prior written consent from CustomerXPs Software pvt ltd.
  • Modification: Users may not modify or create derivative works from any content within the LMS.
  • Technological Measures: Users are prohibited from circumventing or attempting to circumvent any technological measures implemented to restrict actions that violate this usage policy.
  • Legal Compliance: Users shall not use any material or any part of the material from the LMS, including its content, in any way that is unlawful or in breach of any person’s legal rights under any applicable law, or in any way that is oGensive, indecent, discriminatory or otherwise objectionable;

5. Plagiarism

Users must submit original work in all assignments and must properly credit any sources or materials referenced. Plagiarism, or the act of presenting another’s work as one’s own, will not be tolerated and will result in disciplinary action, which may include revocation of LMS access and notification to the user’s organization.

6. Privacy and Confidentiality

  • Users must respect the privacy and confidentiality of all other users within the LMS. Unauthorized sharing of personal data, discussions, or any training-related content with external parties is strictly prohibited.
  • Users are responsible for any activity on the LMS arising out of any failure to keep their password confidential and may be held liable for any losses arising out of such a failure.
  • On the termination of our contract with user’s organization, all data is archived and made inaccessible. If Users wish to exercise any of the rights under data protection law in relation to this personal data, please contact us.

7. Enforcement and Penalties

  • Users shall not use the LMS in any way or take any action that causes, or may cause, damage to the LMS or impairment of the performance, availability, accessibility, integrity or security of the LMS or in any way that
    is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity, or do anything that interferes with the normal use of our LMS.
  • Users will not create a link to LMS from another website or document without CustomerXPs Software pvt ltd consent.
  • Violations of this policy shall result in a range of penalties, including but
    not limited to: suspension of access to the LMS, legal action for breach of
    contract, and/or financial penalties for damages incurred by CustomerXPs Software pvt ltd.
  • CustomerXPs Software pvt ltd reserves the right to immediately
    terminate the access to the LMS, if in our reasonable opinion, any of the User is found to be in violation of this policy.

8. Availability of LMS

CustomerXPs Software pvt ltd has the right to suspend or restrict access to LMS and/or to functionality of LMS. For example, access to course maybe suspended during server maintenance or during updates. CustomerXPs Software pvt ltd will try to give User’s reasonable notice of any suspension or restriction.

9.Limitations and exclusions of liability

  • Nothing in these terms and conditions will limit or exclude any liability for death or personal injury resulting from negligence or for fraud or fraudulent misrepresentation, limit any liabilities in any way that is not permitted under applicable law or exclude any liabilities that may not be excluded under applicable law.
  • In no event shall CustomerXPs Software pvt ltd be liable for any indirect, incidental, special, punitive, or consequential damages, any loss of profits, loss of business and/or goodwill, revenue.
  • CustomerXPs Software pvt ltd aggregate liability to you shall not exceed an amount equal to the price paid for the LMS training.

10. Amendments

CustomerXPs Software pvt ltd reserves the right to amend this policy at any time. Users will be notified of any changes and are expected to comply with any amended terms as a condition of continued LMS access.

11. Governing law and jurisdiction

This policy shall be governed by the laws of India, and courts in Bangalore shall have the exclusive jurisdiction.

12. Agreement

By signing in for the LMS, users are agreeing to abide by the terms of this policy and any subsequent amendments.
